1.          Privacy Policy

1.1        All emails, documents, images or other recorded information held or used by TSC, including the Intake Form is Personal Information, as defined and referred to in clause 9.3, and therefore considered Confidential Information. TSC acknowledges its obligations in relation to the handling, use, disclosure and processing of Personal Information pursuant to the Privacy Act 1988 (the Act).

1.2        TSC acknowledges that in the event is becomes aware of any data breaches and/or disclosure of Your Personal Information held by TSC that may result in serious harm to You, TSC will notify You in accordance with the Act. Any release of such Personal Information must be in accordance with the Act and must be approved by You, by written consent, unless subject to an operation of law.

1.3        Notwithstanding clauses 9.1 and 9.2, privacy limitations will extend to TSC in respect of Cookies where You utilise TSC’s website to make enquiries. TSC agrees to display reference to such Cookies and/or similar tracking technologies, such as pixels and web beacons (if applicable), such technology allows the collection of Personal Information, such as Your:

(a)        IP address, browser, email, client type and other similar details;

(b)        Tracking website usage and traffic; and

(c)         reports that are available to TSC when TSC sends an email to You, so TSC may collect and review that information;

(together, Personal Information).

1.4        If You consent to TSC’s use of Cookies on TSC’s website and later wishes to withdraw that consent, You may manage and control TSC’s privacy controls via Your web browser, including removing Cookies by deleting them from the browser history when exiting the site.

1.5        You agree that the Personal Information may be used and retained by TSC for the following purposes (and other agreed purposes or required by law):

(a)        the provision of the Services (including to contact and communicate with You and prepare a sleep plan and advice); and/or

(b)        analysing, verifying and/or checking Your credit, payment and/or status in relation to the provision of the Services; and/or

(c)         processing of any payment instructions, direct debit facilities and/or credit facilities requested by the Customer; and/or

(d)        enabling the collection of amounts outstanding in relation to the Services.

1.6        You shall have the right to request (by e-mail) from TSC:

(a)        a copy of the Personal Information about You retained by TSC and the right to request that TSC correct any incorrect Personal Information; and

(b)        that TSC does not disclose any Personal Information about You for the purpose of direct marketing.

1.7        TSC will destroy any Personal Information retained upon Your request (by e-mail), or if it is no longer required, unless it is required in order to fulfil the obligations of this Agreement or is required to be maintained and/or stored in accordance with the law.
